Microsoft also “reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Microsoft’s sole discretion.” Break the law in front of your Kinect system? You could be up against the law.

That's scary. I don't want Microsoft hearing me. I wasn't getting kinect in the first place, but now definitely not.
Wow I never thought of it that way. Well if I were to get the Kinect I definitely would turn it off before even thinking of doing anything illegal.
If you look at every device carefully enough, you're pretty much being monitored 24/7.

Seriously, this function exists in everything, including your cellphones, why do you think when people disappear or do shit the first thing they do is break your cellphones? Not only is it trackable but they can make your phone turn on and answer itself.
